CAVITEX Infrastructure Corporation (CIC), a subsidiary of Metro Pacific Tollways Corporation (MPTC), has taken legal action by filing criminal complaints against PEATC Officer-in-Charge (OIC) Dioscoro Esteban.

The complaint includes charges of perjury, usurpation, slander, and violation of the Anti-Graft Law. This move comes in response to Esteban's filing of a petition for mandamus with the Court of Appeals and his public statements criticizing CIC.

Esteban, despite lacking any board authority, declared under oath that he is the authorized representative of PEATC. Additionally, he made public statements tarnishing CIC's reputation.
The complaint asserts that PEATC lacks a board of directors, yet Esteban misrepresented his authority to file the mandamus case under oath.
Moreover, he filed the petition through private lawyers, violating the rules of the Office of the Government Corporate Counsel, the legitimate lawyers for GOCCs like PEATC, and against the directives of the Office of the President.
Atty. Criselda Funelas, representing CIC in the Ombudsman case, emphasized that Esteban's public statements against CIC contained false accusations, dishonoring the company's reputation.
Esteban's claim of being authorized when he is not constitutes usurpation while making such a claim under oath is perjury. His actions demonstrate bad faith, manifest partiality against CIC, and gross negligence, all of which are violations under the Anti-Graft and Corrupt Practices Act.
Atty. Funelas emphasized that as a public officer, Esteban must be held accountable for his illegal actions.
