Chicago Woman Sues Wendy's After Burger Meal, Citing $93,000 in Medical Bills

A 68-year-old Chicago woman is suing Wendy's, alleging that she became seriously ill after eating a double cheeseburger and baked potato delivered from the fast-food chain, Chris Morris reported for Moneywise.

Roxie Ellis Douglas alleges that Wendy's failed to use safe food-storage, handling and preparation practices and failed to adequately inspect food and kitchen conditions for possible contamination before serving the meal.

According to the lawsuit, Douglas received the food in a sealed DoorDash delivery bag.

She alleges that after eating the meal, she developed a Campylobacter intestinal infection, acute infectious colitis and other health problems.

A summary of her medical bills attached to the court filing totals approximately $93,578, including expenses from two hospital stays. NBC Chicago likewise reported that the lawsuit alleges more than $90,000 in medical expenses.

Douglas originally filed the case in Cook County Circuit Court. Wendy's Properties LLC removed the case to the US District Court for the Northern District of Illinois on Aug. 20, 2026.

The federal docket identifies the case as Douglas v. Wendy's Properties, LLC, case No. 1:26-cv-10092. Douglas is seeking more than $50,000 in damages.
