Herb Simon, the billionaire co-founder of Simon Property Group and majority owner of the Indiana Pacers, is reportedly suing the family of his late nephew David Simon, alleging that relatives secretly shifted assets and dissolved a decades-old sister company without his permission, Forbes Daily reported.

The company is one of the nation's largest mall developers, with more than 250 properties.

At the center of the dispute is an entity established to hold the family's interests in certain real estate properties that were not incorporated into Simon Property Group when the company went public in 1993.

David Simon, who served as chairman, president and CEO of Simon Property Group, died in March 2026. Herb Simon publicly described David as his nephew and praised his leadership following his death.
