As in 2000, when the SC had to rule on procedural questions in Florida that held national consequences, the court now must rule on state actions in Colorado that shake the foundation of the presidential contest everywhere else.
In the Florida case, the SC ruled to award the state’s electoral votes to presidential candidate George W. Bush via Sandra Day O’Connor’s stand on a procedural issue. A recount showed Al Gore won Florida but the SC did not correct itself.
Now, Roberts is being hammered not only by one case, but two, as special counsel Jack Smith wants him and the SC to rule on defeated President Donald Trump’s claim of immunity.
The other is the Colorado Supreme Court’s deleting Trump’s name from the primary ballot.
One scenario, as advanced by Politico legal editor James Romoser, is that the SC will strike down the Colorado decision and ensure that Trump can continue running for president but also reject the immunity claim and allow Trump’s trial on 91 charges before the November 2024 general election.
